"PROTECTED WORKMAN" ( Industrial Disputes Act, 1947)


 When we learn Industrial Disputes Act, 1947, there are some terms and definitions which require a lot of explanations. Even the courts have tried to interpret these terms in different situations in different ways. Hence an ordinary student will be confused in understanding these terms. The term ' Protected workmen' is one among those most confusing and much interpreted one.
Section 33 (3) reads as follows:
" Notwithstanding anything contained in sub-section (2), no employer shall, during the pendency of any such proceeding in respect of an industrial dispute, take any action against any protected workman concerned in such dispute--
(a) by altering, to the prejudice of such protected workman, the conditions of service applicable to him immediately before the commencement of such proceedings; or
(b) by discharging or punishing, whether by dismissal or otherwise, such protected workman,save with the express permission in writing of the authority before which the proceeding is pending.
Explanation.--For the purposes of this sub-section, a "protected workman", in relation to an establishment, means a workman who, being a member of the executive or other office bearer] of a registered trade union connected with the establishment, is recognised as such in accordance with rules made in this behalf.

Rule 61(1) of Industrial Disputes (Central) Rules, 1957, provides that every registered trade union connected with an industrial establishment shall communicate to the employer before the 30th April every year, the names and addresses of the officers of the union who are employed in that establishment who should be recognised as protected workmen. Rule 61(2) makes it obligatory on the part of employer to recognise such number of workers as provided u/s 33 (4) of the Industrial Disputes Act, 1947, as ‘protected’ for a period of 12 months, within fifteen days of receipt of the proposal from the union.

How many protected workmen?

As per Section 33 (4) of the Industrial Disputes Act, 1947, the number of workmen to be recognised as protected workmen shall be one per cent of the total number of workmen employed therein subject to a minimum number of five protected workmen and a maximum number of one hundred protected workmen.

Where the total number of names received by the employer exceeds the maximum number of protected workmen, admissible for the establishment, u/s 33(4) of the Act, the employer shall recognise only such maximum number of workmen as “protected”.

Where there are more than one registered trade unions in the establishment, the maximum number of protected workmen shall be distributed among the unions in such a way that each union shall have representation as protected workmen in proportion to the membership of the unions. If the union is informed that the number of protected workmen allotted to the union is less than that proposed by the union; after submission of the list, the union will have to select from the proposed list the names of such persons who should be recognised as protected workmen and intimate the names to the employer within five days.

Rights of Protected Workmen

Section 33 (3) of Industrial Disputes Act, 1947, provides that during the pendency of any conciliation procedure before a conciliation officer or a Board or of any proceeding before an arbitrator or a Labour Court or Tribunal or National Tribunal in respect of an industrial dispute, the employer should not initiate any action against any protected workman concerned in such dispute-

(a) by altering, to the prejudice of such protected workman, the conditions of service applicable to him immediately before the commencement of such proceedings; or

(b) by discharging or punishing, whether by dismissal or otherwise, such protected workman, save with the express permission in writing of the authority before which the proceeding is pending.


If any employer wants to take action against a protected workman during the pendency of a conciliation proceeding, before the Conciliation Officer, Board, Arbitrators, Labour Court, Tribunal or National Tribunal, he should get express permission from the conciliation Officer, Labour Court or Tribunal, as the case may be, by applying in form J. 

The Kerala High Court in an interesting dispute wherein a Workman who was already facing Disciplinary Action and was facing some proceedings for misconduct was nominated by the Union for recognizing as a 'Protected Workman'. The management declined their request, which lead to the Union approaching the Assistiant Labour Commissioner who passed an order in favour of the Union, granting protection to the nominated workman. The management challenged the said order by filing the Writ Petition.
The Single Judge of Kerala High Court [2010 III LLJ 811] held that “the choice of the individual officers, who are to be recognized as protected workmen has been left to the concerned Trade Union … and once the communication of the Union’s choice is sent to the employer, a mandatory obligation is cast on the employer that it shall recognize the workmen as protected workmen …. even if a Union Official is facing disciplinary action, that does not render him ineligible for being recognised as protected workmen”.
 The management preferred an intra-court appeal and the Division Bench [Justices C. N. Ramachandran Nair & K. Surendra Mohan, HLL Lifecare Ltd. v. Hindustan Latex Labour Union (AITUC),  W.A 1171 of 2010, decided on 3rd November, 2010], reversed the above said judgment of single judge and held that “it is upto the management to consider whether any of the office-bearers nominated by the union is undesirable or ineligible for recognition and if they find so for valid reasons, they are free to reject the nomination of such office-bearer. If the management declines to recognise any office-bearer as protected workman, it is for the Union to either contest the same by raising a dispute before the Labour Commissioner as provided under  sub-rule (4) of Rule 61 of the Rules whose decision shall be final or to send the name of another office-bearer for recognition as protected workman.. However, management is entitled to decline recognition as protected workmen to a person nominated by the union, if any disciplinary proceeding is pending against such workman. Union certainly cannot exercise their power under Rule 61(1) to give immunity to an employee against whom disciplinary proceedings initiated by the management are pending, by nominating his name for recognition as protected workman.”
 Therefore, according the new interpretation, an office bearer of the Union facing disciplinary proceedings is not entitled to be nominated by the Union for recognition as protected workman and the management is absolutely within their powers to decline recognition to such an office-bearer under sub-rule (2) of Rule 61.
In such cases the management should inform its intention to decline the name of a particular worker in the list, within 15 days, failing which it can be presumed that the management has admitted the proposal.

ഒരു ചക്കയുടെ വില............

 ഇന്നലെ ലണ്ടനിലെ  ഹാരോ മാര്‍ക്കറ്റില്‍ പോയപ്പോള്‍ ഒരു പലചരക്ക് കടയില്‍ പഴുത്ത ചക്ക വില്‍ക്കാന്‍ വെച്ചത് കണ്ടു.  സ്വര്‍ണ നിറത്തില്‍ !  ഒരു ചക്ക പ്രിയനായ  എന്നെ നോക്കി ചിരിക്കും പോലെ തോന്നി. എന്തായാലും ഒരു കഷ്ണം ചക്ക വാങ്ങാന്‍ തീരുമാനിച്ചു . അടുത്ത് ചെന്ന് ഒരു കഷ്ണം കാണിച്ചു എടുക്കാന്‍ പറഞ്ഞു. ആറു രസികന്‍ ചുളയുള്ള ഒരു  ചെറിയ കഷ്ണം.  കൌണ്ടെറില്‍ ഇരുന്ന പെണ്‍കുട്ടി ത്രാസ്സില്‍ വെച്ച് തൂക്കി നോക്കിയിട്ട് വില പറഞ്ഞു "ഫൈവ്  പൌണ്ട്സ്". കൂടെയുണ്ടായിരുന്ന മകന്‍ അത് കൊടുത്തു കഴിഞ്ഞപ്പോഴാണ് ഞാന്‍ വില കണക്കു കൂട്ടിയത് .  ആറു പഴുത്ത ചക്കച്ചുളക്ക് നാട്ടിലെ കാശു വെച്ച് കണക്കു കൂട്ടിയപ്പോള്‍ 375 രൂപ . ഒരു ചുളയുടെ വില കൂട്ടാന്‍  നോക്കിയപ്പോള്‍ മോന്‍ പറഞ്ഞു  ഇനി കൂട്ടാന്‍ നിന്നാല്‍ അതിന്റെ രുചി അത്രയും പോകും. എന്തായാലും പിന്നെ കൂട്ടി  നോക്കിയില്ല. ഈ സെപ്റ്റംബര്‍ മാസാവസാനം നല്ല പഴുത്ത വരിക്കച്ചക്ക തിന്നാന്‍ കിട്ടിയതല്ലേ. ഒന്നും നോക്കാതങ്ങു  വീട്ടിലേക്കെടുത്തു .       375  രൂപക്ക് കിട്ടിയ ആറു വരിക്ക  ചുളകള്‍ !!!!!! ഒരു നിധി പോലെ ഞാന്‍ ചേര്‍ത്ത്   പിടിച്ചു. അപ്പോഴും എന്റെ മനസ്സില്‍ നിന്ന് ഒരു ചക്കക്കു എന്ത് വില കിട്ടും എന്ന അദ്ഭുതം പോയില്ല. കേരളത്തിലെ മൊത്തം ചക്കക്കു!....... അങ്ങിനെ പോയി എന്റെ കണക്കുകള്‍ . ഒരു ചുളയുടെ വില വിവരമുള്ളവര്‍ കൂട്ടിക്കോട്ടേ.

"അത് ഇമിറ്റെഷനാ , പൊന്നല്ല"

      കാമുകനോടൊപ്പം  ഒളിച്ചോടിയ മിനിമോള്‍ക്ക്‌ രേഖകള്‍ പ്രകാരം പതിനെട്ടു വയസ്സ് തികഞ്ഞിട്ടില്ല. കോടതിയില്‍ നിന്നും മജിസ്ട്രേട്ട്  മിനിമോളെ  നിയമ നടപടികള്‍ക്കായി ചൈല്‍ഡ് വെല്‍ഫെര്‍ കമ്മറ്റി അംഗങ്ങളായ  ഞങ്ങളുടെ അടുത്തേക്ക് അയച്ചു. അന്വേഷണത്തിനിടയില്‍  മനസ്സിലായ വസ്തുതകള്‍ നിയമങ്ങല്‍ക്കൊക്കെ അതീതമായി കൌതകകരമായിരുന്നു. 
      നാട്ടില്‍ തന്നെ ഒരു ജോലിയും ഇല്ലാതെ നടക്കുന്ന ഒരു ചെറുപ്പക്കാരനുമായി  അവള്‍ പരിചയമായി. പരിചയം പ്രേമമായി മാറാന്‍ കൂടുതല്‍ സമയമെടുത്തില്ല . പ്രേമം പെട്ടന്നങ്ങ് മൂത്തു.  അയാളുടെ മധുരമൂറുന്ന വാക്കുകള്‍ക്കായി അവള്‍ ദാഹിച്ചു. അതിനായി അയാള്‍ അവള്‍ക്കു ആരും അറിയാതെ ഒരു മൊബൈല്‍ ഫോണ്‍ സമ്മാനിച്ചു - ഒരു ജോഡി ഫോണ്‍ . എപ്പോഴും എത്ര വേണമെങ്കിലും വിളിക്കാം , ഏതുനേരത്തും  സംസാരിക്കാം. ചെലവെയില്ല!! . അച്ഛനും അമ്മയും അറിയാതെ അവര്‍ രാവും പകലും സംസാരിച്ചു. രാത്രിയില്‍ ഉറക്കം വരാതിരിക്കുന്ന കാര്യങ്ങളാണ്‌ അയാള്‍ പറഞ്ഞതധികവും. അതുകൊണ്ട് രാത്രി പുലരുവോളം അവര്‍ സംസാരിച്ചു കൊണ്ടേയിരുന്നു. അയാള്‍ ഒരുദിവസം അവളോട്‌ തന്റെ കൂടെ പോരാന്‍ ആവശ്യപ്പെട്ടു. 
        ഇത് കേള്‍ക്കേണ്ട താമസം അവള്‍ അഞ്ചു മാസത്തെ പരിചയം മാത്രമുള്ള  അയാളോടൊപ്പം പുറപ്പെട്ടു. വീട്ടില്‍നിന്നും അകലെ രാവണേശ്വരം എന്നിടത്തുപോയി അവിടെ അയാള്‍ കൊണ്ടുപോയാക്കിയ ഒരു വീട്ടില്‍ താമസിച്ചു. ഈ വീട്ടിലെ ആരെയും അവള്‍ക്കു അറിയില്ല.            
    ഇതിനിടയില്‍ അച്ഛനും അമ്മയും മകളെ കാണാഞ്ഞ് സകല ദൈവങ്ങളോടും ഒപ്പം പോലിസിനോടും സങ്കടം പറഞ്ഞു. നാലാം ദിവസം പോലീസ് ഇവരെ അറസ്റ്റ് ചെയ്തു കോടതിയില്‍ ഹജരക്കി. അപ്പോഴാണ് പതിനെട്ടു എന്ന കടമ്പ കടക്കാന്‍ ഇനിയും കുറച്ചു ദിവസങ്ങള്‍ ബാക്കിയുണ്ട് എന്ന് മനസ്സിലാക്കിയത്‌. എന്തായാലും അന്വേഷണത്തിനിടയില്‍ മിനിമോള്‍  വാവിട്ടു കരയുന്ന അമ്മയെ ചൂണ്ടി ഞങ്ങളോട് പറഞ്ഞു "ഇപ്പോള്‍ വേണമെങ്കില്‍ ഞാന്‍ അമ്മയുടെ കൂടെ പോകാം. പതിനെട്ടു വയസ്സ് തികയുമ്പോള്‍ ഞാന്‍ വീണ്ടും എന്റെ ഭര്‍ത്താവിന്റെ കൂടെ പോകും. ഞങ്ങള്‍ അമ്പലത്തില്‍ വെച്ച് താലി കെട്ടിയിട്ടുണ്ട്". ഇതും പറഞ്ഞു അവള്‍ ബ്ലൌസിനുള്ളില്‍ ഒളിപ്പിച്ച ഒരു താലി ഞങ്ങളെ കാണിച്ചു. ഇത് എത്ര പവന്‍ വരുമെന്ന് കാണിച്ചു മൊഴി രേഖപ്പെടുത്താന്‍ തുടങ്ങിയപ്പോള്‍ മിനിമോള്‍ ഒരു ഭാവ മാറ്റവും കൂടാതെ പറഞ്ഞു "അത് ഇമിറ്റെഷനാ , പൊന്നല്ല". ഇത് കേട്ട നിമിഷം ഒരച്ഛന്‍ കൂടിയായ ഞാന്‍ ആരും കാണാതെ എന്റെ കണ്ണ് തുടച്ചു . 
   എത്ര ലാഘവത്തോടെയാണ് ഈ കുട്ടികള്‍ ജീവിത പ്രശ്നങ്ങളെ സമീപിക്കുന്നത്...ആരൊക്കെയാണിതിനു കുറ്റവാളികള്‍ ? എല്ലാം ഒരുതരം ഇമിറ്റെഷനായി അവര്‍ കാണുന്നു . ഒരു ഇമിറ്റെഷന്‍ താലിയില്‍ കിടന്നാടെന്ടത് മാത്രമാണോ നമ്മുടെ മക്കളുടെ സ്വപ്നം ? 

  ( കുറിപ്പ്: കുട്ടിയുടെ പേര് ഒഴികെ ബാക്കിയെല്ലാം വാസ്തവവുമായി ചേരുന്നതാണ്. കുട്ടിയെ തിരിച്ചറിയാതിരിക്കാന്‍ കുട്ടിയുടെ പേരും ചില കാര്യങ്ങളും മാറ്റിയതാണ്.)

ഓണാശംസകള്‍ !

ഈ ഓണക്കാലത്ത് 'മദ്യക്ഷാമ'മുണ്ടാകാതിരിക്കാൻ എല്ലാ ഏർപ്പാടുകളും ചെയ്തിട്ടു ണ്ട്   -   മന്ത്രി ബാബു!
-----ഹായ് ഇതല്ലേ   മന്ത്രി.! നല്ല സൊയമ്പന്‍ മന്ത്രി!!
എല്ലവര്‍ക്കും നല്ല നമസ്കാരം ! ഓണം വന്നാലും ഉണ്ണിപിറന്നാലും നമ്മള്‍ക്ക് ബേജാര്‍ ഇല്ലാതെ കുടിക്കാം. ഓണാശംസകള്‍ ! 
കള്ള് കുടിച്ചു മരിച്ചു പോയിട്ടില്ലെങ്കില്‍ അടുത്ത തിരഞ്ഞെടുപ്പിന് പിന്നേം കാണാം .

CHILD ABUSE IN INDIA - A GLIMPSE.

    Child abuse in India is increasing  by all means.This has become quite a common thing that it has lost its news value for the media. The children are being abused at homes, schools and even in public places. Disabled, especially mentally disabled children are being abused about 4 times, more than the other children.

   Children are also being abused at the so called "protection homes" like orphanagesetc. Most of the orphanages in India have became business centers. They are running not because of charity, but to accept income tax free donations and financial assistance from Government and other funding from philanthropists. They keep no empathy for the children.About 70 percent of the children who are in need of care and protection are being abused or neglected here. They bring children through some agents to increase the number of inmates and thereby increase the financial assistance. Nobody knows where these children are being sent or sold. There were a lot of complaints that even organs of these children are being sold in the market. Some private hospitals and doctors are after them.They usually keep the number of inmates confidential. These homes never register themselves under the JJ Act and they fight against these registrations.

   Adoption agencies are another centers of cruelty. There are places in India where they allow unwed pregnant ladies to deliver in their homes on a precondition that the child when born will be given to these centers. They get the written agreement or surrender deed well in advance. Some Notary Publics are more than thier paid employees for the attestation these deeds. Recently CARA in india has proposed that the surrender should be made in the presence of any CWC member. This proposal is being opposed by the adoption centers and they are on a fight against it.

    Our children should not have fear of their family. Family is place where they should get support, comfort, protection and care.  But instances are being reported that children are being abused at their homes. Fathers, close relatives are all involving in this cruelty. Children in high risk families, where there are alcoholic and violent parents are in constant fear even their homes.

    Child Labour is another form of abuse. All surveys show that the number is increasing. But surprisingly all the officials to curb this manace is turning deaf ears to it . The political parties and trade unions are also least bothered because these children are not vote banks. 

    We, as socially responsible citizens,  must bring out a better stronger awareness among the people about the vulnerable children.We have to create services to help children who have been neglected and abused; both mentally, and physically.We have to bring a service minded forum which will ensure child protection.( The present systems in JJ Act is only a bureaucratic set up which have proved it's limitations and failures.) We must think empathetically and make a difference to the life of these neglected beings.
